Complete Dismissal of all Federal Claims for County Sheriff’s Department

In 2025, the Eastern District of California granted summary judgement in favor of the County Defendants regarding a 42 U.S.C. § 1983 claim involving the failure to administer medical care at the scene of a shooting. The Plaintiffs alleged that several Sheriff’s Department deputies failed to render medical care following a drive by shooting involving rival gangs. We were able to successful argue via body worn camera and expert reports that the Sheriff’s Department deputies timely and appropriately rendered medical care until the fire department and EMS personnel arrived on the scene. The case resulted in a complete dismissal of all federal claims.
