9th Circuit​ Affirms Summary Judgment for County of Nevada For Monell Claims

Shareholder Matt Gross successfully affirmed a summary judgment ruling for the County of Nevada in the 9th Circuit Court of Appeal. In a recent unpublished decision, John Peterson v. County of Nevada, 2026 WL 67583 (9th Cir. 2026) the Appellant argued that during a 2018 arrest the County and its jail medical contractor California Forensic Medical Group failed to provide medical care during a 48 hour detention, and the failure to provide medical care led to a serious infection.

The Court determined that the County and its medical contractor did not violate Appellants constitutional rights and provide numerous examinations which were documented in the medical chart. The Court also rejected Appellant’s argument that the County violated the Monell doctrine and affirmed that the County had constitutionally appropriate and adequate policies in place to provide medical care to inmates at the Jail and during their discharge.
