Porter Scott Wins Summary Judgment on behalf of U.C. Davis Medical Center in Fair Employment and Housing Act Case

In a significant victory for Porter Scott, the California Superior Court for the County of Sacramento granted a motion for summary judgment in favor of the Regents of the University of California (“UC Regents”). The plaintiff had sued his former employer, the UC Davis Medical Center, on grounds that he was constructively discharged from his employment because of alleged harassment by his coworkers and supervisors. He asserted claims under the Fair Employment and Housing Act (“FEHA”) for disability based on his gender, age, and disability (Murrieta v. UC Regents, et al.).

The court granted summary judgment, dismissing the action, on grounds that the UC Regents demonstrated with significant evidence that the UC Davis Medical Center employees and supervisors presented legitimate, non-discriminatory justifications for their actions, and that the plaintiff had failed to present sufficient evidence suggesting that those justifications were pretext for discrimination. The court further held that the UC Regents presented evidence establishing that the plaintiff was neither subjected to a hostile work environment nor was he forced to resign.
