Porter Scott Obtains Favorable Verdict in Admitted Liability Case

Porter Scott recently obtained a favorable jury verdict on behalf of an insured Defendant in a strict liability case under the dog bite statute. Defendant’s dog knocked over the minor Plaintiff and allegedly bit him in the back of the head. Liability was admitted and the dispute in the case was about the reasonable amount of damages for Plaintiff’s future medical expenses and his past and future pain, suffering, and emotional distress. Plaintiff asked the jury to award $528,000. The jury was clearly more convinced by the defense view of damages and awarded $60,000, well under the defense 998 Offer of $75,000.
