Porter Scott Wins Summary Judgment On Behalf Of The Regents Of The University Of California

Porter Scott’s obtained a favorable ruling on a Motion for Summary Judgment for The Regents of the University of California (“The Regents”) in Yolo County Superior Court. The plaintiff alleged that UC Davis created a dangerous condition of public property under Government Code section 835 in connection with an apartment fire that caused the death of the plaintiff’s spouse. The court found that The Regents were entitled to fire-related immunities under Government Code sections 850, 850.2, and 850.4, based on an independent state investigation concluding the apartment complex had appropriate, reasonable fire life-safety devices and that The Regents did not cause the fire. The court also held the plaintiff failed to present a triable issue of material fact that would defeat those immunities.
