Porter Scott Wins Another Motion for Summary Judgment on Civil Rights Case

Shareholders Stephen Horan and William Camy successfully defended a local municipality and its police officers, prevailing on a Motion for Summary Judgment with respect to Plaintiff’s federal civil rights claims. The City’s officers were investigating a reported potential DUI. During the investigation, the suspect tried to walk away from the officers. The officers physically detained and arrested the suspect for obstructing the investigation. Plaintiff sued alleging the officers violated his civil rights and maliciously prosecuted him. The Court held that the officers were entitled to qualified immunity and barred Plaintiff’s civil rights claims. The Court dismissed Plaintiff’s state law claim for lack of jurisdiction which Plaintiff elected not to pursue. Great job Steve and Will!
