Another Win For the Public Entity Team in Labor Code Retaliation/PAGA Case
Shareholders Steve Horan, Will Camy, and Associate Matt Gross obtained summary judgment on behalf of the County of Butte against Plaintiff’s alleged Retaliation/PAGA claims brought pursuant to Labor Code Sections 98.6 and 1102.5. The Court held that Plaintiff, a County Behavioral Health probationary employee, was released for legitimate, non-discriminatory reasons rather than her allegedly protected whistleblower complaints. The Court dismissed Plaintiff’s Complaint in its entirety as a matter of law, saving the County from incurring the cost of a lengthy, expensive trial as well as the risk of exposure to Plaintiff’s attorney fee claim.
