To what extent can a school discipline a student for comments posted by the student on FaceBook? To what extent can a public employer discipline an employee for comments posted on social networking sites or in an e-mail? Does it matter how the posting was discovered or if the posting occurred while at school/workplace or occurred off campus/worksite? Technology is changing the way we communicate and those changes are raising interesting First Amendment and privacy issues. As technology changes, so must the law. We will discuss recent case law, will present real life examples of issues faced by schools and employers, and engage in an open discussion regarding the constitutional issues technology raises at school and in the workplace. The session will be designed to be largely interactive and will incorporate audio/visual presentation and audience participation.
